Overview

Under the general direction of the Chief Legal Officer, you will be an integral member of a highly talented team, with responsibility to provide valued legal counsel across Fairview’s businesses. The Legal Counsel position supports and reports to a senior attorney on regulatory and transactional related matters primarily supporting the service lines (e.g. Heart & Vascular, Neuroscience, Solid Organ Transplant, Behavioral, Cancer Care, Musculoskeletal, Medical sub-specialties, Women’s and Children’s Health and Surgical Specialties) as well as the hospital/acute care setting and the position will support drafting, reviewing and negotiating a variety of contracts primarily with independent physicians and physician groups for a variety of services or affiliations. The Legal Counsel will also support transactional work involving joint ventures and mergers and acquisitions. The Legal Counsel will work with other attorneys and clients to understand issues and priorities, apply sound legal analysis, and identify and assess risks and opportunities, and provide actionable recommendations and solutions that meet client needs while maintaining compliance with applicable laws, regulations, and Fairview policies.

Responsibilities/Job Description

  • Draft, review and negotiate contracts with independent physicians and physician groups for a variety of services and develop contract templates.

  • Develop, revise and mature contracting processes and policies and train management and executives on an ongoing basis.

  • Handle multiple legal matters simultaneously and coordinate with others on regulatory, compliance, and operational issues.

  • Stay apprised of important changes in law and regulation, and counsel senior attorneys and business leaders on such changes.

  • Act as a resource to other members of the Legal Department.

  • Provide direction to paralegals.

  • Other duties as assigned.

Qualifications

Education:

  • Juris Doctorate from an accredited law school with a strong academic record.

Licensure:

  • Licensed to practice law in Minnesota or have the ability to become licensed within one year of employment.

Experience:

  • 2 to 5 years of legal experience in a law firm or healthcare organization, with primary focus on federal and state laws and regulations affecting the business of healthcare facilities including the Stark Law, Anti-kickback Statute, Anti-trust laws; Medicare, Medicaid fraud and abuse; laws pertaining to tax-exempt entities; experience drafting, reviewing, and negotiating contracts preferred. Strong analytical skills and ability to develop solutions and recommendations quickly and accurately.

  • Excellent judgment and communication skills (both written and oral).

  • Ability to prioritize projects, stay on task, and manage workload in a fast-paced work environment.

  • Pragmatic business-focused attorney who can work collaboratively to effectively manage legal risks.

  • Comfortable working independently and collaboratively as part of a team.

  • Ability and willingness to assist with other projects as assigned by senior attorneys.
